Lawyer Profile - Scott K. Spivack

Firm co-founder Scott K. Spivack has over 19 years of legal experience. Formerly the President of the Polk County Criminal Defense Lawyers Association (from 2004 to 2006), Mr. Spivack has concentrated his practice in the areas of criminal defense, family law and eminent domain. Mr. Spivack graduated with a B.A. in History from Lehigh University in 1986, and a J.D. from the University of Miami School of Law in 1989. During law school, Mr. Spivack was awarded the American Jurisprudence Award, representing excellence in the study of Jurisprudence. Licensed to practice law in state courts throughout Florida, Mr. Spivack’s experience prior to entering the private practice of law has included the following:

  • Felony Division Chief, Office of the Public Defender for the Tenth Judicial Circuit
  • Trial Attorney, Office of the Public Defender for the Tenth Judicial Circuit
  • Senior Attorney (Eminent Domain), Florida Department of Transportation

Mr. Spivack founded his own firm, Scott K. Spivack, P.A. in 2000, concentrating on complex matters in the areas of criminal defense, family law and eminent domain, and has recently merged his practice with the law firm of John L. Martinez, Jr., P.A. to form the firm of Martinez & Spivack, P.A. Mr. Spivack’s practice continues to concentrate on the representation of clients in the areas of family law, criminal law, eminent domain and civil/business litigation.

Mr. Spivack has extensive litigation experience, and has tried hundreds of cases before juries and judges throughout the State of Florida. The wide range of cases Mr. Spivack has tried have included:

  • Criminal Defense: cases ranging from murder, robbery, burglary, aggravated assault, aggravated battery, drug offenses, domestic violence, DUI and theft
  • Family Law: cases ranging from dissolution of marriages (divorce), petitions for custody, modifications of custody, petitions for child support, modification of child support, petitions for visitation, modifications of visitation, and injunctions for protection
  • Eminent Domain: cases involving issues as diverse as contaminated land, wetlands and associated environmental concerns, business damages, severance damages, costs to cure, mobile home parks, and complex zoning and future land use issues

Combining years of experience in the courtroom with formidable negotiation skills, Mr. Spivack has always believed that the most effective way to represent his clients is through aggressive, zealous and proactive representation. Mr. Spivack maintains a Martindale-Hubbell rating of "BV", indicating high to very high legal ability and very high ethical standards as established by confidential opinions from members of the Bar.

Concerned with matters of legal ethics and professionalism, Mr. Spivack has obtained the level of Master in the Willson American Inn of Court, a group of 65-70 lawyers in Polk County who give back to the legal community by teaching the professional and ethical practice of law to less experienced lawyers.

Mr. Spivack and his wife, LaDella, live in Lakeland.
